End User License Agreement

This End User License Agreement (“EULA”) is a legal agreement between you and Tappa (“we”, “us”) governing your use of the Moose iPhone application and any updates to it (“the app”). By downloading, installing, or using the app, you agree to this EULA. If you do not agree, do not download, install, or use the app.

1. License grant

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the app on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service. This license is for your own personal, non-commercial planning use.

2. Scope of license

The license is valid for the app and any updates we provide. You may not distribute or make the app available over a network where it could be used by multiple devices at the same time, except as allowed by Apple’s Family Sharing or volume purchasing programs.

Moose is a planning and tracking tool only. It does not provide legal, immigration, or professional advice. Estimates, timelines, and CRS calculations are approximate and for planning purposes only. Always verify information with official Government of Canada resources on Canada.ca or a licensed immigration representative. Moose is not affiliated with, endorsed by, or operated by Immigration, Refugees and Citizenship Canada (IRCC) or the Government of Canada.

5. Your content and data

The applications, dates, notes, and travel history you enter are stored locally on your device and remain your responsibility. Your use of the app is also governed by our Privacy Policy.

6. Ownership

The app is licensed, not sold, to you. We and our licensors retain all right, title, and interest in and to the app, including all intellectual property rights, artwork, and the “Moose” name and branding.

7. Apple-specific terms

This EULA is between you and Tappa only, not with Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-party list.

8. Termination

This license is effective until terminated. Your rights under this EULA will end automatically if you fail to comply with any of its terms. You may terminate it at any time by deleting the app from your device.

9. Disclaimer of warranties

The app is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that public data feeds will be accurate, timely, or available.

10. Limitation of liability

To the maximum extent permitted by law, Tappa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your reliance on the app, including missed deadlines or decisions based on estimates.

11. Governing law

This EULA is governed by the laws applicable in Canada, without regard to conflict-of-law principles, except where local mandatory consumer-protection laws apply.

12. Changes to this EULA

We may update this EULA as the app evolves. Material changes will be reflected here with an updated date, and your continued use of the app constitutes acceptance of the revised EULA.
