This End User License Agreement ("EULA") applies to Loopiva: Crochet for Beginners ("the Application") and is concluded between you and the developer of the Application ("Licensor"). The Application is licensed, not sold, to you. This EULA incorporates Apple's standard Licensed Application End User License Agreement; where this EULA and Apple's standard EULA conflict, the more protective term for the end user applies.
1. Scope of license
Licensor grants you a non-transferable license to use the Application on any Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and the Usage Rules. The license is limited to personal, non-commercial use.
2. Restrictions
You may not distribute or make the Application available over a network where it could be used by multiple devices at the same time. You may not copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Application, except as permitted by law.
3. Consent to use of data
You agree that the Licensor may collect and use limited technical data and related information as described in the Privacy Policy to provide and improve the Application and its services.
4. Subscriptions & in-app purchases
The Application offers optional auto-renewing subscriptions and a one-time lifetime purchase as described in the Terms of Use. All purchases are processed by Apple and governed by the Apple Media Services Terms.
5. Termination
This license is effective until terminated by you or the Licensor. Your rights under this license will terminate automatically without notice if you fail to comply with any of its terms.
6. No warranty
To the maximum extent permitted by applicable law, the Application is provided "AS IS" and "AS AVAILABLE", with all faults and without warranty of any kind. You use the Application at your own discretion and risk.
7. Limitation of liability
To the extent not prohibited by law, in no event shall the Licensor be liable for personal injury or any incidental, special, indirect or consequential damages arising out of or related to your use of, or inability to use, the Application.
8. Apple as third-party beneficiary
You acknowledge that this EULA is concluded between you and the Licensor only, and not with Apple. Apple is not responsible for the Application or its content. Apple and Apple's subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance, will have the right to enforce it against you. The Licensor, not Apple, is solely responsible for the Application, its content, maintenance, support and any product claims, including product liability, legal or regulatory compliance, and intellectual property claims.
9. Maintenance and support
The Licensor is solely responsible for providing maintenance and support for the Application. Apple has no obligation to furnish any maintenance and support services with respect to the Application.
10. Legal compliance
You represent and warrant that you are not located in a country subject to a U.S. Government embargo, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
